Employment Lawyers Serving Babylon, New York
Babylon is both a small incorporated village on the Great South Bay and the name of a 218,000-person town that stretches north to the Long Island Expressway, and the difference matters when you are figuring out where your employment case belongs. Babylon Village is also the end of the electrified LIRR Babylon Branch, so a large share of local residents work in New York City, which can put a more protective law in play. TA Legal Group represents Babylon employees from our Huntington office, about fifteen miles north.

Why does “Babylon” mean two different things in an employment case?
Because the name covers a small village and a large town, and your case follows the employer, not the postmark. The incorporated Village of Babylon is about 2.8 square miles on the Great South Bay, with roughly 12,000 residents. The Town of Babylon that surrounds it counted 218,223 people in the 2020 census and extends north to the Long Island Expressway, taking in Lindenhurst, West Babylon, North Babylon, Copiague, Amityville, Deer Park, Wyandanch, and East Farmingdale.
Those places have very different economies. The village is a walkable downtown of restaurants, bars, and small professional offices. Deer Park and Wyandanch are warehouse, distribution, and big-box retail. East Farmingdale is a college campus and an airport. West Babylon is dominated by health care.
Even the Town of Babylon’s own town hall is not in the village. It sits at 200 East Sunrise Highway in Lindenhurst, and Parks and Recreation runs out of 151 Phelps Lane in North Babylon. If the address on your pay stub says Babylon, that tells you almost nothing about where your employer operates or which court will hear your case.
What is different about working for the Town of Babylon itself?
Two things: the procedural rules that apply to any municipal employer, and a seasonal workforce far larger than most towns run.
Start with the seasonal side, because it is genuinely unusual. The Town’s Parks and Recreation department operates three ocean beaches (Overlook, Cedar, and Gilgo), two bay beaches at Venetian Shores and Tanner Park, town marinas, pools, spray parks, and an 18-hole par-three golf course at Cedar Beach. Ocean beaches open weekends and holidays from late May and run daily from mid-June into early September. That calendar is staffed by full-time employees plus a large part-time seasonal workforce: lifeguards, gate and parking attendants, camp counselors, concession staff, grounds crews, and marina hands.
Seasonal municipal work is still employment. A summer job does not suspend the overtime rule, the requirement to pay for all hours actually worked, or the requirement to keep accurate time records. Mandatory training and certification sessions, equipment checks, and post-closing cleanup are working time if the employer requires them.
The procedural side applies to every Town of Babylon employee, seasonal or not, and to the eight school districts inside the town. The anti-discrimination statutes apply to public employers exactly as they apply to private ones. Layered on top you may have Civil Service disciplinary protections, a union contract with grievance and arbitration procedures, and (for tenured teachers and administrators) the hearing process under New York Education Law § 3020-a.
The catch is timing. Certain claims against a municipality require a notice of claim on a deadline dramatically shorter than the ordinary statute of limitations, and union grievance clocks are often measured in days. Filing a grievance does not stop a limitations period from running, and a grievance outcome does not necessarily resolve a statutory discrimination claim. If you work for the Town, a village, a school district, or a fire or library district here, the sequence you file in matters as much as the merits.
What kinds of wage claims come out of the Babylon economy?
The claims track the employers, and Babylon’s employers fall into five clusters.
Health care Health care and social assistance is the single largest sector employing West Babylon residents, at roughly 3,928 workers in 2024 figures. Northwell Health’s South Oaks Hospital at 400 Sunrise Highway in Amityville runs inpatient behavioral health units for children, adolescents, adults, and older adults along with substance use treatment. Catholic Health’s Good Samaritan University Hospital in West Islip (537 beds including 100 nursing home beds) sits just over the Islip line and also runs a Babylon location on Deer Park Avenue. Around them are nursing homes, home care agencies, and outpatient practices. Around-the-clock care generates a consistent set of disputes: automatic meal-break deductions taken from staff who never got an uninterrupted break, unpaid charting and shift-handoff time on either end of the punch, disputed shift differentials, and coordinators paid a salary while performing plainly non-exempt work. See unpaid overtime, meal and rest breaks, and off-the-clock work.
Restaurants and bars Downtown Babylon Village holds roughly thirty restaurants across West and East Main Street and Deer Park Avenue, with the 500-seat Argyle Theatre drawing evening traffic and boating season pushing summer volume up sharply. Four claims repeat. An employer may take the tip credit and pay a reduced cash wage only after giving specific written notice and keeping specific records; skip that and it loses the credit entirely and owes the full rate for every hour. Owners, managers, and anyone with real supervisory authority may not share in a tip pool. See tip theft and improper tip pooling. New York requires an extra hour at the basic minimum rate when the span from the start of your first shift to the end of your last exceeds ten hours, which doubles and split shifts trigger constantly. See spread of hours pay. And where a manager edits punches to keep a week under forty hours, that is time shaving, usually provable straight out of the point-of-sale audit log.
Retail, warehousing, and manufacturing Tanger Outlets Deer Park runs to roughly 737,000 square feet with more than 100 brands, and the Long Island Avenue and Carlls Path corridor in Deer Park and Wyandanch has been converting steadily to warehouse and distribution use, including a 189,500-square-foot distribution building at 377 Carlls Path. NAPCO Security Technologies, a publicly traded alarm and access-control manufacturer, runs a 200,000-square-foot facility at 333 Bayview Avenue in Amityville. These are time-clock workplaces, and the claims follow: unpaid pre-shift and security-screening time, rounding that always runs one direction, mandatory unpaid meetings before a store opens, “assistant managers” put on salary while stocking shelves and running registers all day, and staffing-agency arrangements where both the agency and the company whose floor you stand on can be liable. See employee misclassification.
Construction, landscaping, and trades The South Shore’s residential trades run heavily on workers labeled independent contractors who function as employees, paid by 1099 or in cash, with no overtime premium, no wage statements, and no workers’ compensation coverage, while the company sets the hours and supplies the equipment. Whether you are an employee turns on how the relationship actually works, not on what the paperwork says. See independent contractor misclassification. Manual workers in New York are also entitled to be paid weekly, which supports late-pay claims under Labor Law § 191.
Education and public employment Educational services is the top sector for Babylon Village residents. Farmingdale State College’s 380-acre SUNY campus in East Farmingdale, Republic Airport next door, eight school districts inside the town, and the Town of Babylon itself employ thousands of people, with the procedural wrinkles described above.
The federal baseline is simple: a non-exempt employee must be paid at least one and a half times their regular rate for every hour over forty in a workweek. New York layers its own protections on top, and under Labor Law § 198(1-a) a worker who proves unpaid wages can generally recover an additional 100% of the amount owed as liquidated damages, plus interest and attorneys’ fees. Because these practices usually affect an entire job title at once, many become wage and hour class or collective actions. The unpaid overtime calculator will give you a rough figure before you talk to anyone.
Do the marinas, boatyards, and the Captree fleet generate their own claims?
Marine work is a real Babylon employment sector, and it produces claims you will not see in an office park.
Babylon Village owns roughly 440 boat berths. Captree State Park, at the end of the Robert Moses Causeway in the Towns of Babylon and Islip, is home to the largest public fishing fleet on Long Island, roughly two dozen independently owned open, charter, and excursion boats operating out of the boat basin. Robert Moses State Park, 875 acres on the western end of Fire Island, is reached through the town. Around all of it sit marinas, boatyards, fuel docks, and haul-out operations.
Three patterns recur. First, deckhands and mates paid a flat day rate, a trip rate, or a cut of the tip jar, none of which eliminates the overtime obligation, because a day rate has to be converted into a regular hourly rate with the premium calculated on top. Second, boatyard and marina crews who work brutal hours during spring commissioning and fall winterization, are paid in cash with no stub, and are then told the season is over. Third, tip handling on boats where the captain or owner takes a share of the passengers’ tips.
Seasonality is not an exemption from anything, and neither is being paid in cash. New York Labor Law requires employers to keep accurate time and payroll records and to issue written wage statements; where the employer kept nothing, courts may let the employee prove hours by reasonable recollection, with the employer bearing the consequence of its own recordkeeping failure.
Which discrimination claims come up most often in Babylon?
Age claims out of the school districts and health care employers, and national origin claims out of the service economy. Babylon’s largest employers are its school districts and health systems, where long-tenured employees are the most expensive people on a payroll, the pattern behind most age discrimination claims. The town’s restaurant, retail, and landscaping workforce produces a different mix, weighted toward national origin discrimination and language-based mistreatment.
Two features of the local employer base shape how these cases run. Many Babylon employers are small (a village restaurant, a boatyard, a twelve-person medical practice, a family contractor) with no HR department, meaning the person you would complain to is often the person causing the problem or their relative. Since 2019 the New York State Human Rights Law has applied to employers of every size, and an employee no longer has to prove harassment was “severe or pervasive” to state a claim, which disproportionately helps workers at exactly those employers. And in the town’s around-the-clock health care and behavioral health settings, disability accommodation disputes are common, usually because a lifting or scheduling restriction gets treated as a disqualification rather than triggering the interactive process the law requires.
Which agencies serve Babylon?
Three matter for most Babylon employees.
The EEOC New York District Office at 33 Whitehall Street in Manhattan handles federal discrimination charges for Long Island. Charges can be filed online, so the Manhattan address rarely means a trip.
The New York State Division of Human Rights keeps its Long Island regional office on Veterans Memorial Highway in Hauppauge, about twenty minutes north of Babylon. It accepts verified complaints under the State Human Rights Law. Be deliberate here: filing with the Division generally forecloses bringing the same claim in court, so it is a decision to make with advice rather than by default.
The New York State Department of Labor’s Division of Labor Standards covers Nassau and Suffolk from its Garden City district office at 400 Oak Street and investigates unpaid wage complaints. In practice a private lawsuit usually recovers more, because liquidated damages and attorneys’ fees are available in court. Suffolk County also runs its own Human Rights Commission in Hauppauge.
Where is the office, relative to Babylon?
Our only office is at 205 E Main St, Suite 3-2, Huntington, NY 11743, about fifteen miles north of Babylon Village, a straight run up Deer Park Avenue. There is no Babylon office, and there is no advantage to a local storefront: the courts that decide these cases sit in Central Islip and Riverhead. We represent employees and executives, throughout Suffolk County. The initial case evaluation is free and confidential. If you want to know whether what happened at work is actionable, ask.
What should employees in Babylon know locally?
- "Babylon" refers to two different places. The incorporated Village of Babylon counted 12,188 residents in the 2020 census and covers about 2.8 square miles on the Great South Bay in ZIP code 11702. The Town of Babylon, which surrounds it, counted 218,223 residents and also contains Lindenhurst, West Babylon, North Babylon, Copiague, Amityville, Deer Park, Wyandanch, Wheatley Heights, and East Farmingdale. An employer with a "Babylon, NY" mailing address may sit in any of them.
- The Town of Babylon's town hall is not in Babylon Village. It is at 200 East Sunrise Highway in Lindenhurst, roughly two miles west, and the Parks and Recreation department runs out of 151 Phelps Lane in North Babylon. That matters mainly for municipal employees, but it is also a reminder that the postal address on your pay stub is not a reliable guide to which court or which town your employer actually answers to.
- The Town of Babylon is an unusually seasonal municipal employer. Its Parks and Recreation department operates three ocean beaches (Overlook, Cedar, and Gilgo), two bay beaches at Venetian Shores and Tanner Park, town marinas, pools, spray parks, and an 18-hole par-three golf course at Cedar Beach, staffed by full-time employees plus a large part-time seasonal workforce. Ocean beaches run weekends and holidays from late May and daily from mid-June through early September. Lifeguards, gate attendants, camp counselors, and grounds crews hired on that calendar are employees, not volunteers, and the overtime and recordkeeping rules apply to them.
- Water is an industry here, not just scenery. Babylon Village owns roughly 440 boat berths, and Captree State Park (which sits in the Towns of Babylon and Islip at the end of the Robert Moses Causeway) is home to the largest public fishing fleet on Long Island, roughly two dozen independently owned open, charter, and excursion boats. Robert Moses State Park, 875 acres on the western end of Fire Island, is reached through the Town of Babylon. Marinas, boatyards, and party-boat operators produce their own wage problems: deckhands and mates paid a flat day rate or a share of the tip jar, off-season winterization work paid in cash, and crews told they are contractors.
- Unlike Commack or Huntington Station, Babylon is served by a single limited-jurisdiction civil court. The Suffolk County District Court, Second District, at 30 East Hoffman Avenue in Lindenhurst covers the entire Town of Babylon. There is no town-line split to sort out.
- Babylon station is the terminus of the electrified LIRR Babylon Branch and a hub for Suffolk County Transit buses. The branch carried roughly 13.5 million riders in 2025, making it one of the railroad's heaviest corridors, and the village sits about 25 miles from New York City. A meaningful share of Babylon's workforce commutes into Manhattan and Brooklyn daily, which is why the New York City Human Rights Law is a live question here.
- Census-derived figures for 2024 put educational services first among industries employing Babylon Village residents (roughly 1,142 workers), followed by professional, scientific, and technical services (roughly 1,019) and health care and social assistance (roughly 885). The average commute is about 33 minutes, and roughly 63% of workers drive alone, a lower drive-alone share than most of western Suffolk, reflecting the rail commuters.
- In West Babylon, the mix flips. Health care and social assistance is the largest sector (roughly 3,928 workers), followed by retail trade (roughly 2,644) and educational services (roughly 2,249). Health care and retail are where off-the-clock, meal-break, and misclassification claims concentrate.
- Named health care employers in and around the Town of Babylon include Northwell Health's South Oaks Hospital at 400 Sunrise Highway in Amityville, a behavioral health facility with inpatient child and adolescent, adult, and senior adult units plus substance use treatment, and Catholic Health's Good Samaritan University Hospital in West Islip, a 537-bed hospital including 100 nursing home beds, just over the Islip line, which also operates a Babylon location on Deer Park Avenue. Behavioral health and long-term care both run around the clock, which is where automatic meal-break deductions and unpaid shift-handoff time show up.
- Manufacturing has not left the town. NAPCO Security Technologies, a publicly traded maker of intrusion and fire alarm, access control, and door locking systems, is headquartered at 333 Bayview Avenue in Amityville and runs a 200,000-square-foot facility there. Production, assembly, and shipping work generates the same off-the-clock, gear-up, and misclassified-supervisor claims as any other plant floor.
- Downtown Babylon Village is one of the densest restaurant and bar districts on the South Shore, roughly thirty restaurants in a walkable downtown running along West and East Main Street and Deer Park Avenue, anchored by the 500-seat Argyle Theatre at 34 West Main Street in the former Bow Tie Cinema building. Tipped work, spread-of-hours pay, and seasonal scheduling disputes cluster in exactly this kind of corridor, and boating season pushes summer volume well past what a village of 12,000 would otherwise support.
- The northern end of the Town of Babylon is an employment center in its own right. Farmingdale State College occupies a 380-acre SUNY campus at 2350 Broadhollow Road in East Farmingdale with roughly 10,000 students and well over a thousand employees, and Republic Airport (owned by the New York State Department of Transportation) supports close to 1,000 aviation and aviation-adjacent jobs next door.
- Deer Park and Wyandanch hold the town's industrial and big-box retail base. Tanger Outlets Deer Park, an open-air center of roughly 737,000 square feet with more than 100 brands, sits just off the Long Island Expressway, and the Long Island Avenue and Carlls Path corridor has been steadily converting to warehouse and distribution space, including a large Thor Equities warehouse built on the former Pinter Brothers truck depot site at 377 Carlls Path.
- Public employment is a major factor. The Town of Babylon itself, plus the Babylon, West Babylon, North Babylon, Lindenhurst, Copiague, Amityville, Deer Park, and Wyandanch school districts, employ thousands of residents. Public-sector workers usually have union grievance procedures and Civil Service protections layered on top of statutory discrimination and wage claims, and the interaction between those tracks is easy to get wrong.
- TA Legal Group's only office is at 205 E Main St, Suite 3-2, Huntington, NY 11743, roughly fifteen miles north of Babylon Village. There is no Babylon office.
Which courts hear Babylon employment cases?
Where a case is filed shapes its timeline and its leverage. These are the courts that most often handle employment claims arising in Babylon and the surrounding parts of Suffolk County.
| Court | Address | Jurisdiction |
|---|---|---|
| Suffolk County Supreme Court (Alan D. Oshrin Courthouse) | 1 Court Street, Riverhead, NY 11901 | Unlimited-jurisdiction state civil court for Suffolk County. Most New York State Human Rights Law and New York Labor Law cases arising in the Town of Babylon are filed and heard here, roughly fifty miles east of the village. |
| U.S. District Court, Eastern District of New York (Alfonse M. D'Amato U.S. Courthouse) | 100 Federal Plaza, Central Islip, NY 11722 | Federal claims arising in Suffolk County (Title VII, the ADEA, the ADA, the FLSA, and FLSA collective actions). This is the closest federal courthouse to Babylon, about eight miles northeast. |
| Suffolk County District Court, Second District | 30 East Hoffman Avenue, Lindenhurst, NY 11757 | Limited-jurisdiction civil, commercial, small claims, and landlord-tenant matters for the entire Town of Babylon, including Babylon Village. |
| U.S. District Court, Eastern District of New York (Theodore Roosevelt U.S. Courthouse) | 225 Cadman Plaza East, Brooklyn, NY 11201 | The Brooklyn seat of the Eastern District, which also covers Kings and Queens Counties. Relevant to Babylon residents whose employer operates in Brooklyn or Queens. |
| U.S. District Court, Southern District of New York (Daniel Patrick Moynihan U.S. Courthouse) | 500 Pearl Street, New York, NY 10007 | Federal claims against Manhattan and Bronx employers. Many Babylon residents who commute on the LIRR work for employers whose federal cases belong here rather than in Central Islip. |
Where would a Babylon employee's case actually be filed?
Venue follows the employer and the statute, not the employee's driveway.
If your claim is federal (Title VII, the Age Discrimination in Employment Act, the Americans with Disabilities Act, or the Fair Labor Standards Act) and your employer operates in Suffolk County, the case is filed in the U.S. District Court for the Eastern District of New York. If your claim arises only under the New York State Human Rights Law or the New York Labor Law, it is generally filed in Suffolk County Supreme Court. If your employer is based elsewhere and you work there, the case may belong in that county instead.
Deciding where to file is a strategic choice, not a formality. It affects which law governs, how quickly the case moves, and what damages are available. It is a decision to make with advice rather than by default. Our employment litigation page walks through what each forum demands.
Does the New York City Human Rights Law reach a Babylon worker?
Often, yes, if you work in the five boroughs. Discrimination law generally follows the workplace and the location of the impact, not your home address. A Babylon resident who commutes into Manhattan, Brooklyn, Queens, the Bronx, or Staten Island is frequently covered by the New York City Human Rights Law even though they live in Suffolk County. That matters, because the city law is deliberately construed more broadly than its state and federal counterparts and permits punitive damages. A Babylon resident who works for a Suffolk County employer generally is not covered by it, and relies on state and federal law instead.
Which discrimination and harassment laws cover Babylon workers?
At least two, and often three. The New York State Human Rights Law applies to employers of every size, so a Babylon employee at a small practice or a four-person contractor is protected even below the federal size thresholds. Title VII, the ADEA, and the ADA apply on top once an employer is large enough. And the New York City Human Rights Law reaches Babylon residents whose work is based in the five boroughs. See workplace discrimination for how these claims are built and which protected characteristics are covered.
Sexual harassment follows the same framework, and State law does not require the conduct to be “severe or pervasive.” If it ends in your firing, that is wrongful termination. At-will has never meant an employer may fire you for an unlawful reason.
What should a Babylon employee do first?
Five things, before you sign anything or send an angry email. Write down the timeline while it is fresh: dates, names, who was present. Get your documents out of the company system before access is cut off, but do not take confidential company data or other employees' information. Pin down the exact legal entity that employs you, not the corporate mailing address. Do not sign a severance agreement on the spot, because a release almost always ends claims you have not identified yet. Have it reviewed first. And know that complaining is protected: punishment for reporting discrimination, harassment, or wage theft is a separate and often stronger retaliation claim.
Watch the calendar throughout. The EEOC's 300-day charge deadline in New York is the one that catches people most often; the others are compared in how long you have to file.
What cases do we handle for Babylon employees?
The same practice we bring everywhere in New York: unpaid wages and overtime, workplace discrimination, sexual harassment, wrongful termination, retaliation and whistleblower claims, and severance review and negotiation. We represent employees and executives.
The firm's only office is at 205 E Main St, Suite 3-2, Huntington, NY 11743. We do not have a Babylon office. Most cases start with a phone or video consultation, and in-person meetings happen in Huntington by appointment. See every area we serve or request a free case evaluation.
Babylon Employment Law: Common Questions
Do I need an employment lawyer with an office in Babylon?
No. There is no legal advantage to hiring a lawyer with a Babylon address. Employment cases for Babylon workers are filed in Suffolk County Supreme Court in Riverhead, in federal court in Central Islip, or in a New York City court if the employer is based there, never in Babylon Village itself. Almost all of the work happens by phone, email, and video. What matters is whether the lawyer regularly litigates employment cases in those courts. We represent Babylon employees from our Huntington office, about fifteen miles north.
Where would my Babylon employment case be filed?
It depends on which law your claim arises under and where your employer operates, not on where you live. Federal claims under Title VII, the ADEA, the ADA, or the FLSA against a Suffolk County employer go to the U.S. District Court for the Eastern District of New York at 100 Federal Plaza in Central Islip. Claims under the New York State Human Rights Law or the New York Labor Law generally go to Suffolk County Supreme Court at 1 Court Street in Riverhead. If your employer is in Manhattan, the federal case may instead belong in the Southern District of New York at 500 Pearl Street, and a state or city claim may belong in a New York County court.
I live in Babylon and take the LIRR into Manhattan. Which law protects me?
Potentially the New York City Human Rights Law, which is broader than federal or state law. Coverage does not depend on where you live. A non-resident who works in the five boroughs can bring an NYCHRL claim if the discriminatory conduct had an impact within New York City, for example, harassment in a Midtown office, or a decision that changed the terms of your NYC-based job. Because Babylon Village is the terminus of one of the LIRR's busiest branches, this applies to a large number of local residents. If you work entirely in Suffolk County, the NYCHRL will not apply, but the New York State Human Rights Law and federal law still do.
Is there a courthouse in Babylon that hears employment cases?
Not for most of them. The Suffolk County District Court, Second District, at 30 East Hoffman Avenue in Lindenhurst covers the whole Town of Babylon, but it is a limited-jurisdiction court that handles small claims, landlord-tenant, and lower-value civil matters. Employment claims involving lost wages, emotional distress damages, and attorneys' fees almost always exceed that court's civil cap, so they are filed in Suffolk County Supreme Court in Riverhead or in federal court in Central Islip.
My employer's address says Babylon but the business is really in West Babylon or Deer Park. Does that matter?
For venue and jurisdiction, what matters is where the employer actually operates, not the mailing address. Babylon Village, West Babylon, North Babylon, Deer Park, Wyandanch, Lindenhurst, Copiague, and East Farmingdale are all within the Town of Babylon and all sit in Suffolk County, so a case against any of them normally proceeds in Riverhead or Central Islip. The distinction becomes important when the same company also has a New York City location, because that can change which law applies and where the case is strongest.
How long do I have to file an employment claim in the Town of Babylon?
The deadline depends on the claim. A federal discrimination charge must be filed with the EEOC within 300 days of the discriminatory act in New York. New York State Human Rights Law and New York City Human Rights Law claims brought in court generally carry three years. Unpaid wage claims under the New York Labor Law generally reach back six years, while the federal FLSA typically reaches back two years, or three for willful violations. Because the shortest applicable deadline controls whether a claim survives, assume the clock is already running.
Where do I file a discrimination complaint if I live in Babylon?
You have three routes. You can file a charge with the EEOC, whose New York District Office is at 33 Whitehall Street in Manhattan and which accepts online filings. You can file a verified complaint with the New York State Division of Human Rights, whose Long Island regional office is on Veterans Memorial Highway in Hauppauge, about twenty minutes north of Babylon. Or you can file directly in court under the State Human Rights Law. The choice has real consequences (filing with the State Division generally means you cannot bring the same claim in court), so get advice before you file anything.
Which wage claims are most common among Town of Babylon workers?
Given the local mix of health care, education, restaurants, big-box retail, warehousing, and municipal employment, the recurring claims are unpaid overtime for employees wrongly treated as exempt, off-the-clock work before and after scheduled shifts, automatic meal-break deductions taken from workers who never got a break, tip and spread-of-hours violations in the Main Street and Deer Park Avenue restaurant corridor, and independent-contractor misclassification in the trades. Under New York Labor Law § 198(1-a), an employee who proves unpaid wages can generally recover an additional 100% of those wages as liquidated damages, plus interest and attorneys' fees.
